Another successful week for the consumer and Collision Safety Consultants. We were approached back in April by a consumer from a non-English speaking background who had their claim denied. The accident was 100% not their fault but their insurer – Guild Insurance – denied the claim stating the policy excluded any driver under the age of 25 years. The at-fault driver for the accident was uninsured. Acting under the authority of the consumer, we made several requests for the cla...im file notes which the insurer would NOT provide. After attempts to resolve the dispute internally were exhausted, we lodged a complaint with the Financial Ombudsman Service (FOS), there is no cost to consumers using this dispute resolution process. Our argument was that Section 54 of the Insurance Contracts Act 1984 applied and the claim should be accepted. In summary, section 54 has the effect that an insurer may not deny indemnity based on a technical breach of the policy or other act or omission after the policy was entered into unless the breach, act or omission could reasonably be said to have caused or contributed to the loss the subject of the claim. Within weeks of the application to FOS, the Insurer called me to advise they would now accept the consumer’s claim and as a result the customer would now receive a payment of $14,700. They only got this result because they chose to seek advice rather than rely on what their Insurer had told them. Guild Insurance will now be pursued through ASIC and the Office of Australian Information Commissioner for a copy of the claim file notes because we at CSC believe that their behaviour falls below the community standards and expectations of a General Insurer. This is what happens to customer service when your insurer (in this case NRMA) decides to send jobs offshore to India, Philippines and South Africa. While the recorded message thanked me for my patience and reassured me my time was valuable I gave up of waiting just short of 92 minutes.

We were contacted by a AAMI insured who was concerned about the repairs to his Toyota Corolla. The vehicle was moved from his nominated repairer and taken to the Suncorp Recommended Repairer. We inspected the vehicle at the nominated repairer who had completed an underbody measurement that indicates misalignment. The vehicle has now been returned to the original repairer for rectification, we will be checking to see if the welding improves on the second repair attempt. another reminder if you want to be able to choose the repairer, you need to choose a policy that gives you that choice.

We were asked to inspect a 2017 Golf GTi for an owner who was concerned his vehicle had not been returned to pre-accident condition. The owner went with the NRMA recommended repairer Parramatta Smash Repairs who has several manufacturer badges. We found the owners concerns justified, why do some repairers choose to show a lack of care for a customers vehicle? If your vehicle has been repaired we recommend a post repair inspection to make sure the repairer has followed the recommended procedures and you don't suffer a diminished value when you sell the vehicle.

Another successful outcome for the customer today, we posted the situation of a NRMA insured on 24 May and found out today the insured will not have to get the vehicle rectified. A big thank you to NRMA Customer Relations for applying some common sense.

We were asked to carry out a post repair inspection on this Hilux after the insurer promoted their services to the not at fault owner. The owner was not happy with the first attempt on the colour match - the second attempt has created additional problems. Masking of waist moulds and weathershilelds?Why would you ever trust an insurer recommendation on where to have your car repaired?

We recently had the opportunity to assist an elderly lady who Vero Insurance were pursuing a recovery of $1,760 against. The repairer who contacted us advised there was minimal damage to the door mirror of her car. The quote and images for the insured vehicle did not match which Vero claims agreed with. Maybe insurers should provide assessors with images of both vehicles so they can conduct an accurate assessment. If you receive demands from an insurer it pays to get a second opinion but more important is to get images at the scene of the accident. A thank you to Vero claims for applying common sense.

The repairer has replaced rear bumper and beaver panel. When asked about masking process he explained "Without appropriate trim and or glass removal, there are weaknesses incorporated into the final repair. It is likely that the car will not be fully restored to its pre-accident condition in both appearance and overall quality. There are considerable negative implications for car owner satisfaction, body shop quality and lifetime repair warranty." Thanks for allowing me to share Bob McLaren.
