Do you use E- commerce? Who doesn't these days! I am often asked about Clickwrap agreements. But what are they?
Clickwrap is a form of agreement used for software licensing, websites, and other electronic media.
Have you ever seen a statement like this outside a software's packaging "You agree to our licence terms and conditions by opening this package".
... That means that you effectively indicated your agreement to their licence terms by unwrapping the plastic packaging around the box containing the software.
Clickwrap agreements are the ONLINE equivalent of these physical also so called 'shrinkwrap agreements'.
It requires the user to agree to terms and conditions before using a website or completing an installation or online purchase process.
The terms and conditions are followed by a check box with the words "I agree" or "I accept" that you must actively click.
Common examples: - Downloading or installing software. - Purchasing an airline ticket or online music. - Registering an account on a social media website.
These agreements are highly enforceable because of the requirement of a positive act of acceptance by the user.
This is particularly important for websites with e-commerce, social media, and other features where enforceable terms will be required to establish the contract and protect against liabilities.
An important tip:
If using a check box to indicate acceptance, DO NOT preselect the box, LET THE USER DO SO.
If you are business utilising eCommerce (selling/advertising your products and service ONLINE) you must have an agreement for your terms and conditions of business, and probably, a Clickwrap Agreement.
That ensures that you are not just compliant with Consumer laws and clear about how you provide your services, but also that YOU GET PAID by laying down your conditions for payment before the relationship with your customer starts.

Do you know what Consumer Guarantees are?
They are statutory assurances under the Australian Consumer Law (ACL) that apply minimum standards to the supply of goods and services to consumers.
And why do you need to know this?

Another great victory for our practice and client this morning at Sydney District Court against the big end of town. We are getting used to it...almost!!!
The judiciary system has spent billions in adopting cutting edge technology, it is evolving as our multicultural society also so does, and today it made clear the point that the investment will not go to a waste: substantive evidence will be allowed by Audio Visual Link (AVL) whenever it is in the interest of justice to do ...so.
Our client was grossly wronged and we are very confident this will be a big win all the way, to the end.
We have gotten everything we asked the Court to this date regardless the 4 corporate defendants and 2 large international tier firms we are fighting against.
Even our own Counsel didn't think our creative solution would stick. It did !!! Why wouldn't it ? The resources are available, justice is simple and logical, almost mathematical.
Just be creative when it comes to finding solutions, where else can we find a way? Be bold, don't be afraid to push your common sense envelope and trust your better judgement. ALWAYS.
Hooray! It is another happy episode of this saga for our Practice and Client. ­¤æ®ŌĆŹ­¤Äō­¤ż»­¤żŚ­¤Åå­¤Äē

We are content and proud of what we achieved today at the District Court of New South Wales against 4 large corporate defendants and their lawyers from two of the largest international firms in Australia.
Yes, we are not afraid to be creative and have faith in our instinct, eve...n at Court, setting trends. We will pursue what we believe to be just and right against whoever may be, owners of large shopping centres, developers, trustees, funds and their big dog glossy lawyers from the high end of town with your 20 pages affidavits served on your opponent half hour before a hearing. The Australian legal system is dealing with changes and challenges as the society here also so does. And the good news are: it is evolving alongside it. So happy with our Court system today.
Our client is currently stuck in New Zealand. We were granted orders for important expert evidence to not just be collected in New Zealand but to be produced to the Court at hearing by video link AVL.
